• Status of State 1% Cap Waiver Requests as of April 20, 2018

    • Waivers have been approved for the following states (15):
    AR, DE, GA, LA, KY, MA, MO, MS, NE, OH, SD, TN, TX, WV, WI

    • Waivers have been partially approved for the following states (3):
    AZ, HI, IN (approved for ELA/Math, denied for Science assessment)

    • Waivers have been denied for the following states (2):
    ME and PA (due to failure to test at least 95% of students with disabilities)

    There remains a question regarding states that may exceed the 1% cap yet have refrained from submitting a request to exceed the cap because the state failed to assess at least 95% of all students and at least 95% of students with disabilities which is a requirement to request a waiver. The US Dept. of Education has been asked to provide information on how such states will be handled. When that information is received it will be posted here.
